National Forum ‘Growing up together’ – Grandir Ensemble

For disabled children’ access to home and leisure structures and (www.grandir-ensemble.net)

Formed on September 2007 at the initiative of the Fédération Loisirs Pluriel, with the support of the Fondation de France and grouping together about thirty local or national organizations, the Plate-Forme Nationale Grandir Ensemble has conducted a national survey on “the disabled children’ and teenagers’ access conditions to home and leisure structures, since the youngest age”.

This survey has the aim to serve as a reference basis for all concerned (managers, communities, fundraisers etc.) and to submit concrete proposals for a real development of an offer of home and leisure adapted to the disabled children’ and teenagers’ needs and their families’.

Findings of this survey have been disclosed on Wednesday 24 June 2009, Sciences Po. This survey (carried out between January and December 2008) is a first in France on the ground of its detailed treatment, included under its legal angle. It has allowed to bringing out 15 concrete measures grouped together around:

  • Development of the offer
  • Staff training
  • Technical support to management organizations and quality of home and information of families
  • Boosting a national awareness and a mobilization of all involved persons

CMS Bureau Francis Lefebvre: a mécénat of competences

We have taken part in the legal facet of this survey under the form of a mécénat of competences around the topic of ‘tort and criminal liability of managers in the matter of disabled children’ or presenting health disorders in home and leisure structures’.

This analysis has allowed to laying the foundations of the legal reflection on this issue and, without being able to solve the problem, to purpose to the Government the appointment of a committee of reflection on the legal and regulatory stakes, in charge of making proposals of improvement.

This committee ought to be composed of distinguished law professors, judges, disabled children’ parents representative associations and representatives of management organizations of homes.
