Pension and Benefit Plans




Company pension and benefit plans have developed rapidly over the past ten years for two main reasons:
  • The difficulties faced by the basic (often State-run) pension and health insurance systems have increased the need for supplemental collective or individual plans
  • Due to the burden of taxation and other payroll taxes on salaries, companies increasingly offer additional salary components that qualify for preferential tax treatment and benefits, with the aim of encouraging staff loyalty
Companies and insurers require assistance when implementing these plans, given the growing complexity of applicable regulations.

Our Practice Areas

We advise our clients on the following matters:
  • Implementing benefit plans (additional healthcare, disability, death and life insurance)
  • Implementing supplemental pension plans (defined benefits, defined contributions, collective pension plans, company pension plans)
  • Compliance audits of these plans particularly with regard to the new rules and regulations arising out of the Fillon Act on retirement eligibility and benefits and the Act reforming the health insurance system
  • Managing the impacts of corporate restructurings on supplemental employee benefits
  • Legal issues concerning mutual insurance (mergers of mutual insurance undertakings of different categories, regulatory compliance audits, etc.)
  • Advisors to insurers
  • Litigation relating to supplemental employee benefits (disputes with the social security authorities relating to pension and benefit plans, application of the Evin Act prohibiting smoking in the workplace, etc.).
