The courts are becoming increasingly involved in various areas of the law. In the business world, we have seen a surge in the number of cases involving the civil or criminal liability of a firm's directors or shareholders. The growing complexity of contractual relationships within a company has also led to greater recourse to the courts or to arbitration procedures to resolve conflicts or difficulties. Companies are faced with a conflicting need for transparency, particularly in terms of financial practices and corporate governance, and the need to protect their vital interests rapidly. In this environment, they are confronted with an increasing number of pre-litigation and litigation situations which require effective defence.
